Ok, I’m a bit late to comment on this, but this seems strange to me: if you followed Adam Curry’s lawsuit against a dutch magazine printing his Flickr images, you may have wondered about the absence of comments by either the EFF or Creative Commons.
Now that the judge has spoken, the durch chapter of CC appears out of nowhere and celebrates victory.
I’d like to join in, but can you call it a victory if nobody gets punised when they violate the license for the first time? All the judge basically said was ‘Don’t do that again!’. I don’t even see any mention whether they had to apologize, retract magazines from newsstands or anything like that.
To me, that means CC is a failure.
