Now this is going to be cool – finally the gloves come off: Dave Winer says Adam once promised him 50-50, and whatever happened to that, while Adam Curry is pissed at that claim and tries to rebutt it by trying to make it dependant on podcasting history, which he is currently trying to re-write. Oh yes, you might want to read what Kevin Marks has to say about the issue.
As an innocent spectator, this is a hell of a lot of fun.
Legally, I guess Dave has nothing. Adam may have promised him 50-50 (I remember Adam talking about this in one of the early DSC’s), but that would have been subject to a common venture, which they never had (my interpretation).
Ethically, most of what Adam does now is based on technology Dave more or less invented, and on the talks the two had at the time. So I’d say at least he owes him a stake in the company. Not 50 percent (which probably Adam himself doesn’t own any more), but something at least.
I understand very well that without Adam, there probably wouldn’t be podcasting as we know it now. I have also probably listened to every single DSC ever made, and I happen to like it a lot.
Still, where I come from, your parents teach you to never forget your friends on the way up – you may need them if you come down again.
